In Circular 2022-03, the CFPB stated that under the Equal Credit Opportunity Act, creditors must give specific and accurate reasons for adverse action, even when a complex or “black-box” model made the decision.

2Discussion

The circular says a creditor’s lack of understanding of its own model is not a defence against this requirement.

3Conclusion

This underlines the importance of explainable AI in credit: models must allow the key drivers of each decision to be identified and communicated clearly.
