The EU AI Act: Credit Scoring as a “High-Risk” System

1Introduction

The EU Artificial Intelligence Act (Regulation (EU) 2024/1689) entered into force on 1 August 2024 with a risk-based approach: some practices are prohibited, some are high-risk with strict requirements, others face transparency duties or none.

2Discussion

High-risk uses include AI systems that evaluate the creditworthiness of natural persons or establish their credit score, except systems used solely to detect financial fraud. Providers must ensure risk management, data quality and governance, technical documentation, logging, transparency, human oversight, accuracy and security.

3Conclusion

Application is phased: prohibitions from February 2025, general-purpose AI obligations from August 2025 and most high-risk requirements from August 2026. For fintechs, credit models must be explainable, documented and human-supervised by design.
